Legal and ethical constraints that apply to social media and website design!

Copyright

Copyright is the protection of expression of ideas. Copyright covers writing, a photograph, music, a film, a web page. Once the idea has been given a physical form then it is covered by copyright. There is no need for registration or to claim copyright in some way, protection is automatic at the point of creation. Both published and unpublished works are protected by copyright. Copyright is owned by the creator of the work, e.g. an author, composer, artist, photographer etc. If the work is created in the course of a person's employment, then the copyright holder is usually the employer.

Marilyn Monroe by Andy Warhol
Roy Lichtenstein version of appropriation using Disney's Mickey Mouse and Donald Duck
Roy Lichtenstein and Andy Warhol  both used a type of art called Appropriation. Appropriation is the use of pre-existing images or objects with very little to change them. Appropriation is understood to be the borrowing of elements for a new creation.

Intellectual Property

Intellectual Property is a legal concept which refers to creations of the mind for which exclusive rights are recognised. It is the law that prevents other people and companies stealing designs that someone has created.

Intellectual Property prevents people from stealing trademarked signs and logos that are used by other companies.
Intellectual Property rights are there to protect the design and creation of new technology. Its purpose is to protect investment of the designing of new technology.

Permission

Copyright is there to protect people work from being used by someone else but it certain cases if someone asks permission to use other people works then it is not a breach of the copyright law. Permissions is only eligible when something is long enough, or requires permission for someone else to use your work.

Libel and sensitivity to groups of society

When you are creating a new piece of work, you have to be careful that you are not breaching the copyright law. But also you have to be careful that you are not discriminating against groups in society.
